Terms of Service

1. Parties and Agreement

These Terms of Service govern your use of the PropertyZ website (propertyz.ug) and the PropertyZ property management portal, operated by PropertyZ, a company registered in Uganda. By accessing our website or portal, you agree to these terms in full.

2. Services Provided

PropertyZ provides the following services, subject to separate written agreements where applicable:

• Property management on behalf of property owners
• Tenant sourcing, screening, and onboarding
• Rent collection tracking and receipt generation
• Condominium service charge management
• Maintenance and repair coordination
• Land sales facilitation and title verification
• Monthly owner financial reporting
• Property and land valuation

3. Property Owners

By engaging PropertyZ to manage your property, you agree that:

• PropertyZ will collect rent on your behalf and deduct an agreed management fee before remitting your net balance
• Expenses below UGX 100,000 may be approved by the PropertyZ Supervisor without prior notice; 100K–250K by the Manager; above 250K requires your explicit approval
• You will receive a monthly financial report reviewed by two PropertyZ managers before dispatch
• PropertyZ reserves the right to place and remove tenants in accordance with standard property management practice
• PropertyZ is not liable for non-payment of rent by tenants beyond reasonable collection efforts

4. Tenants

By renting a property managed by PropertyZ, you agree that:

• Rent is paid directly to the property owner's account as specified in your tenancy agreement
• You must notify your Property Officer of any maintenance issue through the PropertyZ portal or by phone — not directly to the owner
• Service charges (where applicable) are separate from rent and non-negotiable
• PropertyZ may record and store proof of your payments, maintenance requests, and communications for the duration of your tenancy and up to 7 years thereafter
• You must give 30 days' written notice before vacating the property

5. Website Use

• Property listings on this website are for general information only. PropertyZ makes reasonable efforts to ensure accuracy but does not guarantee that listings are current at the moment of viewing
• Submitting a viewing request, property alert, or contact form does not constitute a tenancy agreement or reservation
• You must not use this website to submit false, misleading, or fraudulent information
• Automated scraping or bulk downloading of listings is prohibited without written consent

6. Management Fees

PropertyZ charges a management fee of 10% of rent collected from each managed property. This fee is distributed internally as follows: 60% to PropertyZ operations, 20% to the referring party, 10% to the active referrer, and 10% to the assigned Property Officer. For condominium buildings, a fixed monthly management fee is agreed separately in writing.

7. Intellectual Property

All content on this website — including text, layout, logos, and software — is owned by PropertyZ or its licensors. You may not reproduce, distribute, or create derivative works without written permission.

8. Limitation of Liability

PropertyZ is not liable for:

• Losses arising from tenant default or non-payment beyond our standard collection procedures
• Physical damage to property by tenants where reasonable precautions were in place
• Third-party service failures (banks, WhatsApp, MTN/Airtel)
• Force majeure events: floods, pandemics, government restrictions

Our total liability to any party is limited to the management fees paid to PropertyZ in the 3 months preceding the claim.

9. Dispute Resolution

Any dispute between PropertyZ and a client will be resolved first by negotiation. If unresolved within 30 days, disputes will be referred to mediation under the Uganda Arbitration and Conciliation Centre. The governing law is Ugandan law and the courts of Uganda have exclusive jurisdiction.

10. Changes to Terms

PropertyZ may update these Terms at any time. Changes that materially affect your rights will be communicated by WhatsApp or email 14 days before taking effect. Continued use of our services after the effective date constitutes acceptance.
